  Adoption of Rules on Limited Teaching License and Criminal Records Check Requirement

The Teacher Standards and Practices Commission amended OAR 584-036-0062to clarify Criminal Records Check Requirements and OAR 584-0060-0171 to remove the requirement of passing the Basic Skills Test for renewal of the Limited Teaching License.

The unamended OAR 584-036-0062 accepted a Fingerprint-Based Criminal History Verification Form processed through the Oregon Department of Education (ODE). ODE clears all fingerprints, regardless of criminal history, unless a crime listed in ORS 342.143 was committed. By accepting these Verification Forms from ODE, applicants with a criminal history other than those listed in ORS 342.143, may have been processed for licensure. The amendments made to the rule allow TSPC to conduct its own fingerprint and criminal background check of applicants to ensure the professional standards of competent and ethical educators is maintained. A temporary rule was adopted September 17, 2003. Public hearings to consider testimony to adopt as a permanent rule were held January 8, 2004, and May 6, 2004.

Amendments to OAR 584-0060-0171removed the requirement of passing the Basic Skills Test for renewal of the Limited Teaching License. Some educators were unable to pass the test due to language barriers and their licenses are expiring. The Commission needed to renew these licenses immediately to prevent hardship to districts and students. The school districts may determine whether these teachers require Basic Skills Testing. A temporary rule was adopted November 13, 2003. Public hearings to consider testimony to adopt as a permanent rule were held January 8, 2004, and May 6, 2004.

The above rules were filed as permanent rules with the Secretary of State on May 14, 2004.
