  Public Hearings on Amendment of Administrative Rules
  Released: Friday, June 17, 2011 at 5:12 PM

The Teacher Standards and Practices Commission (TSPC) will conduct a public Rulemaking Hearing on Wednesday, June 22, beginning at 1:00 p.m. at the TSPC office, 465 Commercial Street NE, Salem, OR, regarding the administrative rules listed below.

584-080-0008 Scope of Administrator Licenses: Adopts new rule regarding the scope of Administrator Licenses. Rule provides guidance for when an administrator license is required and when it is not.

584-005-0005 Definitions: Expands the definition of administrator licenses to require an administrator license when supervising or disciplining other licensed personnel, or authorizing out-of-school suspension or expulsion of students.

584-060-0062 Adding Endorsements to Initial [I, Initial II] or Continuing Teaching Licenses: Corrects paragraph numbering inconsistency.

584-070-0411 Initial School Social Worker License: Clarifies that accredited master's degree is required but eliminates the requirement to also hold an accredited bachelor's degree. Clarifies that School Social Workers may not refer to themselves as school counselors or school psychologists.

584-070-0421 Continuing Social Worker License: Clarifies that accredited master's degree is required but eliminates the requirement to also hold an accredited bachelor's degree. Eliminates the need to hold an active license with the Oregon Board of Licensed Social Workers.

584-080-0012 Initial Administrator License (IAL) : Clarifies requirements for renewal of IAL's issued prior to or after August 1, 2011. For these newly-licensed administrators, the first IAL license (3 years) can only be renewed one time (for another 3 year period). In order to be renewed, at least 6 semester or 9 quarter hours of graduate credit must be completed to show progress toward the Continuing Administrator License.

The "Notice of Proposed Rulemaking Hearing" and the "Statement of Need and Fiscal Impact" were filed with the Secretary of State on May 13, 2011, and were published in the June 1, 2011, edition of the Oregon Bulletin.

Both written and oral testimony may be presented for the commission's consideration. The proceedings will be digitally recorded and a summary of all testimony will be presented to the commission. Testimony will be allowed on these rules until 2:00 pm on July 21, 2011, at the next commission meeting.

Due to a clerical error, the following two rules were inadvertently added to the June 22, 2011 hearing document. In fact, these two rules (OAR 584-036-0055 and OAR 584-070-0431) were already heard at a previous rulemaking hearing in April and adopted as "permanent" by the commission. A corrected rule hearing document was filed with the Secretary of State on June 15, 2011, to remove them from consideration at the June hearing. The commission then voted to file them as permanent rules at the May 2011 meeting.
