  NOTICE OF ADMINISTRATIVE RULES HEARING
  Released: Tuesday, December 20, 2011 at 3:25 PM
 
 
 
FOR PROPOSED ADOPTION BY
TEACHER STANDARDS AND PRACTICES COMMISSION.

The rules listed below have not yet been adopted by the commission. These are draft rules that will be considered for adoption at the next commission meeting on February 2, 2011.
The purpose of this notice is to inform all interested parties that:
* An Administrative Rulemaking Hearing will be held January 23, 2012.
* This hearing will be held from 1:00 to 3:00 p.m. at the TSPC office at 250 Division Street, Salem, OR, in the main conference room.
* The reason for holding this hearing is to allow all interested parties an opportunity to provide comment either in person at the hearing itself or in writing by 2:00 p.m. on February 2nd.
(The rule hearing notice was filed with the Secretary of State on December 15, 2011.)
These are the proposed rules being considered for adoption:
ADOPT:
584-036-0057 Late Fee Waiver - Allows educators who are unable to find employment during the life of a license to waive late fees upon reinstatement of their license issued by TSPC.

584-090-0100 Professional Development General - Requires professional development for all educators including charter schools and school nurses.

584-090-0105 Professional Development Objectives - Adopts objectives that align with the national standards adopted by Learning Forward.

584-090-0110 Standards for Professional Learning - Clarifies the professional development standards are aligned with the national standards developed and adopted by Learning Forward in 2011.

584-090-0115 Continuing Professional Development Requirement - Clarifies requirements for CPD.

584-090-0120 Approval of Continuing Professional Development - Requires educators who are currently employed or unemployed to supply evidence their CPD was completed at the time of renewal.

584-070-0441 Restricted Transitional School Social Worker - Creates new license for districts who wish to license persons who are completing a school social worker program or who are planning to enroll in a school social worker program.

584-070-0451 Emergency School Social Worker License - Adopts new license to allow districts to hire an emergency social worker. The license allows for an "extension" without issuing an "informal" extension to a license.

AMEND:
584-036-0055 Fees - Amends rule to state: (9)(c) If the educator is eligible for fee waiver under OAR 584-036-0057, the Executive Director may waive late fees.

584-036-0015 Basic and Standard Teaching Licenses with Authorizations and Endorsements - Clarifies waiver of Basic Skills Tests (7) in lieu of a Master's Degree. Removes "building limitations" from the rule except for Specialty Endorsements.

Interested parties may email written comments to Kathleen Rogers. Oral comments can be made directly to the commission at the meeting on February 2, 2012. Testimony will be accepted until 2:00 p.m. at the commission meeting at the Keizer Renaissance Inn.

Lynn D. Beaton, Director of Licensure, serves as the agency's hearing officer. The hearing will be recorded for permanent record. Written testimony may be submitted at this time. The hearing officer will adjourn the public hearing and will not respond to questions. After the close of the public comment period, a report will be prepared to submit to the commission at the February meeting.

Opportunity for oral hearing shall be granted upon request received from 10 persons or from an association having not less than 10 members before the earliest date that the rule could become effective after the giving of notice.
